EFFICIENT USE OF ARBITRATION: Drafting of Arbitration Clauses
The drafting of an arbitration clause can be time consuming. However, arbitration sometimes is the recipient of a "black eye" as counsel and parties complain, sometimes rightfully, that the arbitration process had not saved attorney fees or costs, not produced any better sort of justice, nor reduced delay. We see in this paper why that might be.

The Battle to Determine the Right to Regulate Hydraulic Fracturing ("FRACKING"): The Preemption Doctrine
An overview of the general facts and law in two separate and ongoing litigations involving the City of Longmont, Colorado ("Longmont"): one lawsuit involving the attempt of the Longmont City Council in July 2012 to impose restrictions as to oil and gas development, particularly fracking, within the city limits and a second litigation involving the passage of Ballot Initiative 300 by the voters of Longmont in November 2012 completely banning fracking in the city limits. The legal analysis here focuses on the legal Doctrine of Preemption.

"Unless" provisions oil and gas leases strictly construed — A reminder from the Supreme Court of North Dakota
When administering oil and gas leases, it is important to make certain that where an agreement includes the use of "unless" clauses that payments be timely made or work be timely performed. Otherwise, even where the Lessee acts in good faith or engages in simple mistake, the Lease automatically terminates.

Colorado Oil and Gas Conservation Commission New Rule 205A – Hydraulic Fracturing Chemical Disclosure
As of April 1, 2012 the Colorado Oil and Gas Conservation Commission ("COGCC") has made effective its Rule 205A. Under this new Rule, the Operator of the wll in question must within 60 days following the completion of the fracking, but in no event more 120 days after the beginning of fracking, "...complete the Chemical Registry Form and post the form on the Chemical Registry ..."
