Safe social media use during divorce

Over the past several years, the use of social media evidence in divorce cases has steadily grown.

People have an innate desire to share personal information on social media. When it comes to divorce, any information that is shared over social media can be used as evidence. Tweets, posts, photos - it's all fair game.

Are you using social media in a way that could hurt your divorce case? Start out by asking yourself these questions:

  • Are you complaining about your ex on Facebook?
  • Are you posting photos of expensive new purchases?
  • Are you sharing photos or information about a new love interest?
  • Are you boasting about a pay raise?
  • Are you checking in one place - but you've told your ex that you're somewhere else?

Every comment, every tweet, every photo you share can tell a story that you may not want told during your divorce. In a time when virtually everything is shared online, you can never be too careful.

More surprisingly, the rules apply to emails and text messages as well. Evidence from any of these sources may be admissible as courtroom evidence.

So play it safe - very safe - on social media before, during, and even after your divorce. If you don't want your messages or photos to show up in the courtroom, don't share it!
