An overview of the general facts and law in two separate and ongoing litigations involving the City of Longmont, Colorado ("Longmont"): one lawsuit involving the attempt of the Longmont City Council in July 2012 to impose restrictions as to oil and gas development, particularly fracking, within the city limits and a second litigation involving the passage of Ballot Initiative 300 by the voters of Longmont in November 2012 completely banning fracking in the city limits. Colorado Oil and Gas Conservation Commission New Rule 205A - Hydraulic Fracturing Chemical Disclosure
As of April 1, 2012 the Colorado Oil and Gas Conservation Commission ("COGCC") has made effective its Rule 205A. Under this new Rule, the Operator of the will in question must within 60 days following the completion of the fracking, but in no event more 120 days after the beginning of fracking, "...complete the Chemical Registry Form and post the form on the Chemical Registry ..."
