60 Seconds with an Attorney: Mark J. Fischer

Who is a personal representative?Mark

That term is used for the administrator of a probate estate. A personal representative, after being appointed by a court, has 3 basic duties:

  • Gather the assets
  • Pay the legitimate bills
  • Distribute the remaining assets to the heirs- if there is no will. Or, to the beneficiaries named in a will.

A personal representative must act as a fiduciary in the best interest of the heir.
